Child custody and visitation

Custody and access decided on the welfare of the child, not on which parent argues harder.

Child custody and visitation rights are usually among the major disputes that arise after a divorce.

In most cases, each parent tries to persuade the court that he or she should be given custody. The law provides that the welfare of the child is the paramount consideration, not the interests of the disputing parents. The court weighs many factors under the Law Reform (Marriage and Divorce) Act 1976 and the Guardianship of Infants Act 1961, together with decided cases.
