Claims where a contractual duty, a duty in tort, or both, have been broken.
The first question is whether there is a breach of a duty in tort, a breach of contract, or both. In tort, damages are unliquidated: they are assessed by the court rather than fixed in advance. For breach of contract, the injured party claims the loss that flows from the broken promise, including damages that were agreed where the contract provides for them.
A breach of contract is the infringement of a personal right. The duty that is broken is a specific duty owed by one party to the other. Contract law in Malaysia is codified in the Contracts Act 1950.
