Conveyancing

Sale and purchase of freehold, leasehold, and Malay reserved land, with and without title.

Conveyancing is the transfer of legal title in property from one person to another, so that the purchaser takes the title with the rights that run with the land.

Property in Malaysia may be freehold, held in perpetuity; leasehold, being land owned by the state and leased, commonly for 30, 60, or 99 years; or Malay reserved land, where ownership is restricted.

What the work covers

  • Sale and purchase agreements for property with title: parties, recitals, the deposit, conditions precedent, and the mode and timing of payment.
  • Agreements for property without title, including the essential preliminaries, documentation, and execution.
  • Real property gains tax, redemption, a purchaser’s private caveat, and non-perfection of a deed of assignment.
